Dutch Regulator Addresses Three Operators Over Marketing Violations

The Kansspelautoriteit (KSA) has formally addressed three licensed operators following marketing compliance breaches that exposed vulnerable groups to gambling promotions, highlighting ongoing challenges in digital marketing oversight.

TonyBet and Betcity faced regulatory intervention for sending promotional materials to young adults aged 18-24, a demographic classified as vulnerable under Dutch gambling regulations. Meanwhile, Kansino violated advertising placement rules by running promotions within mobile gaming applications.

Email Marketing Violations Target Young Adults

TonyBet triggered regulatory scrutiny after sending promotional emails to young adult players on two separate occasions. The operator attributed both incidents to system errors that failed to properly identify recipients as belonging to the vulnerable 18-24 age group, instead classifying them as standard adult participants.

Betcity's violation involved distributing marketing messages through its gaming interface to all registered players, including young adults. The operator clarified that affected young adult players could not access the promoted offer, though the exposure itself constituted a regulatory breach.

Both operators self-reported their violations to the KSA, demonstrating proactive compliance. Following regulatory discussions, TonyBet and Betcity implemented enhanced marketing system controls and adopted four-eyes verification principles to prevent future incidents.

Mobile Gaming Advertisement Breach

Kansino faced enforcement action for placing gambling advertisements within mobile gaming applications, a practice explicitly prohibited under Dutch regulations. Gambling operators cannot conduct recruitment or advertising activities in online games beyond licensed gambling platforms.

The operator discovered and self-reported the violation, immediately removing the advertisements after detection. This swift remedial action influenced the KSA's enforcement approach regarding illegal gambling operations.
