KSA Updates Dutch Municipal Gaming Machine Supervision Guide

The Kansspelautoriteit (KSA) has released an updated version of its Wegwijzer Speelautomaten voor Gemeenten, providing Dutch municipalities with enhanced guidance on gaming machine supervision and enforcement. The refreshed guide addresses key challenges local authorities face when overseeing gambling operations within their jurisdictions.

The Dutch gambling regulator developed the updated guidance in collaboration with the Vereniging van Nederlandse Gemeenten (VNG) and conducted extensive consultations with municipal staff. These discussions revealed that local authorities require greater clarity on identifying illegal gambling operations and understanding the division of responsibilities between municipalities and the KSA.

The revised guide incorporates the latest legislation and regulations while better addressing municipalities' practical information needs. Local authorities can utilise the resource for licensing and operations oversight, conducting supervision and enforcement activities, and ensuring gaming machine operators fulfil their duty of care obligations.

Municipal Gambling Authority Overview

Dutch municipalities have dual authority in gambling oversight: they issue presence licenses (aanwezigheidsvergunning) determining physical locations for gaming machines, and enforce local gambling regulations through APV (Algemene Plaatselijke Verordening). This local authority complements the KSA's national supervision, creating a two-tier regulatory system that addresses both location-specific concerns and broader compliance issues.

Practical Implementation Tools

The updated framework provides municipalities with enhanced tools for recognising illegal gambling offerings and understanding their specific role in enforcement. The guide serves as a comprehensive reference for addressing gaming machine-related issues and similar gambling activities.
