Madrid Strengthens Gaming Tax Legal Certainty and Periodic Review

The Community of Madrid has approved two significant initiatives with direct impact on the tax and regulatory sphere of the region, including taxes on gaming, marking a substantial shift toward enhanced taxpayer protection and systematic regulatory oversight.

New Taxpayer Defense Framework

The Government Council approved the draft Law for the Defense of the Taxpayer, which will now begin parliamentary proceedings in the Madrid Assembly. The new law will be applicable to taxes ceded by the State whose management corresponds to the Community, including Tax on Patrimonial Transfers and Documented Legal Acts, Successions and Donations, Patrimony and Taxes on Games.

According to the Madrid Executive, the objective is to strengthen legal certainty for taxpayers, simplify fiscal procedures, and improve relationships between citizens and the regional tax administration.

Among the main innovations is the creation of an individualized tax folder that will allow taxpayers to consult in real time all tax information and the status of files. Additionally, the Community commits to using clearer administrative language and easy-to-understand forms.

The future law also contemplates the creation of an Office for the Defense of the Taxpayer, which will replace the current figure of the Taxpayer Ombudsman. The new Office will assume management of complaints and suggestions related to administrative delays, telematic incidents, or deficiencies in citizen service.

Systematic Regulatory Review Process

Alongside this initiative, the regional Government approved the draft decree that will introduce a permanent system of review and evaluation of regional regulations. The measure establishes that all regional legal systems must be reviewed every four years to check effectiveness and adequacy to economic and social reality.

Furthermore, organizational regulations will have a maximum validity of five years, after which they must be evaluated for maintenance, modification, or repeal.

Administrative Simplification Measures

The new model will promote administrative simplification through the expansion of cases where positive administrative silence may be applied. When the Administration fails to resolve within deadline, citizen or business applications may be considered approved.

An abbreviated procedure is incorporated for the drafting of certain laws and rules of special simplicity, significantly reducing administrative processing times.

Positive Silence Strategy

Gaming operators should leverage the expanded positive administrative silence provisions by ensuring all applications are properly documented with submission dates and tracking numbers. If the Administration fails to respond within statutory deadlines, applications may be considered automatically approved, providing a valuable compliance pathway.

Strategic Implications for Gaming Operators

These reforms signal Madrid's commitment to regulatory predictability in the gaming sector. The mandatory four-year review cycle creates structured opportunities for operators to influence regulatory development, while the enhanced taxpayer defense mechanisms provide clearer recourse channels for compliance disputes.

The real-time tax information system could streamline gaming tax reporting and reduce administrative friction. However, the periodic evaluation requirement suggests operators should prepare for more frequent regulatory adjustments as Madrid adapts its framework to evolving market conditions, similar to recent tax updates implemented by Cantabria.
