De Kansspelautoriteit (KSA) has taken enforcement action against Legs Eleven Limited for operating unauthorized gambling events under the Bingo Loco brand at prominent Dutch venues.
The regulator issued formal warnings to both the organizer and venues after determining that Bingo Loco events at the Maassilo in Rotterdam and Complex in Maastricht violated gambling regulations. These large-scale commercial events failed to meet the strict legal requirements for license-exempt bingo operations.
Under Dutch law, bingo events can only operate without a license under stringent conditions. The organizer must be a Dutch association established for at least three years and not founded specifically to organize gambling activities. Additionally, proceeds must benefit a pre-announced charitable cause.
Prize limits are strictly capped at €400 per individual prize and €1,550 per event gathering. Events must also be reported in advance to the municipality.
The Bingo Loco events breached multiple requirements, operating as commercial entertainment rather than charitable fundraising activities with prizes exceeding permitted thresholds.
| Requirement | Limit/Condition |
|---|---|
| Maximum Individual Prize | €400 |
| Maximum Event Total | €1,550 |
| Association Age | 3+ years |
| Advance Reporting | Municipal authority |
License-Exempt Requirements
The three-year establishment requirement for Dutch associations ensures organizational stability and prevents shell companies from exploiting the license exemption. Municipal reporting creates a paper trail for oversight, while the charitable purpose requirement distinguishes legitimate fundraising from commercial gambling operations.
Following KSA intervention, the affected parties cooperated to resolve the violations. The bingo events were converted into music quizzes, removing them from gambling regulations entirely while preserving the entertainment format.
Warning
Converting gambling events to alternative entertainment formats requires careful legal review. Music quizzes with valuable prizes could still trigger gambling regulations if chance elements are introduced, making professional compliance advice essential before format changes.
The KSA maintains comprehensive oversight of gambling activities and can impose various sanctions for unauthorized operations, including penalty payments, administrative fines, and seizure of materials and prizes.
The swift resolution demonstrates both regulatory vigilance and industry willingness to adapt formats when faced with compliance challenges – a model that could influence how other entertainment operators approach gambling-adjacent activities in regulated markets.
According to KSA.
